These Terms of Use (“Terms”) govern access to and use of the website available under pelczynski.net (the “Website”), including any pages, blog posts, and downloadable materials published on the Website (the “Content”), and the educational newsletter described below (the “Newsletter”).

These Terms are intended to constitute the “website regulations” / “terms of provision of services by electronic means” within the meaning of the Polish Act of 18 July 2002 on Provision of Services by Electronic Means (UŚUDE), in particular Article 8.

1) Who we are (Service Provider / Operator)

The Operator uses the Attorney’s name, likeness, and professional brand elements (including the name “pelczynski.net”) under a licence granted by the Attorney.

2) Scope — what the Website provides

The Website offers only the following services/features:

  1. Access to Content(reading and viewing).
  2. Downloading Content(e.g., PDFs).
  3. Newsletter subscription(educational updates; marketing only upon separate consent).
  4. Contact(e.g., sending messages to the Operator/Attorney).

No paid features, user accounts, or client portals are provided via the Website.

3) Definitions

  • User: any person accessing or using the Website.
  • Consumer: a natural person acting for purposes outside their trade, business, craft, or profession.
  • Business User: a User acting for purposes within their trade, business, craft, or profession.
  • Policies: separate documents referenced in Section 12 (Privacy Policy, Cookies Policy, Newsletter details), incorporated by reference as attachments to these Terms.

4) Technical requirements

To use the Website, you need (at minimum):

  • Internet access;
  • a modern web browser (e.g., current Firefox/Chrome/Safari/Edge);
  • the ability to display common file formats (e.g., PDF reader);
  • enabled cookies and/or similar technologies to the extent required for the Website’s operation (details in the Cookies Policy).

These Terms also include a prohibition on providing unlawful content via the Website (see Section 6), as required for the “regulations” under Polish law.

5) Educational purpose only — no legal advice

All Content is provided for general educational and informational purposes only (EU tech and data law: e.g., AI Act, GDPR, data governance, cybersecurity, digital regulation, and related topics).

Nothing on the Website constitutes:

  • legal advice, legal opinion, or professional recommendation;
  • a substitute for individualized advice from a qualified professional;
  • an invitation to establish an attorney–client relationship.

No attorney–client relationship is created by:

  • accessing the Website;
  • reading/downloading Content;
  • subscribing to the Newsletter;
  • sending a message through the Website or to a listed email address.

An attorney–client relationship can arise only through a separate, explicit written engagement (and conflict checks), signed/confirmed by the parties thereto (and, where relevant, agreed fees and scope).

6) Rules of use (acceptable use)

You agree to use the Website lawfully and in a way that does not interfere with others’ use.

In particular, you must not:

  • provide or transmit unlawful content (including content infringing third-party rights);
  • attempt unauthorized access, probe vulnerabilities, or bypass security;
  • introduce malware or disrupt the Website’s operation;
  • impersonate others or misrepresent affiliation or endorsement;
  • use the Website in a way that could reasonably be expected to cause harm to the Operator, the Attorney, or other users.

Automated access (including crawlers) is allowed only to the extent it is lawful, non-disruptive, and complies with Section 7 (licensing) and Section 9 (disclaimers). We may implement reasonable technical measures to protect availability and security.

7) Intellectual property, ownership, and licensing

7.1 Copyright ownership

Unless explicitly stated otherwise, all Content published on the Website (including blog posts and PDFs) is protected by copyright and related rights and is owned by the Attorney.

The Operator is a licensee of the Attorney and is authorised to:

  • publish and make the Content available on the Website; and
  • grant the public permissions described below (including by applying a public licence).

7.2 Default public licence — CC BY-NC 4.0

Unless a specific item states otherwise, the Content is licensed to the public under:

Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0).

This means (summary only; the licence text controls):

  • You may copy and share the Content for non-commercial purposes, with attribution.
  • You may create and share adaptations (including translations) for non-commercial purposes, with attribution and an indication of changes.
  • You may not apply legal/technical restrictions that would prevent others from exercising rights granted by the licence.
  • The licence does not grant trademark rights; and it includes a “no endorsement” rule.

7.3 Additional permissions beyond CC BY-NC 4.0

To match your intended use cases, the Attorney (via the Operator) grants the following additional permissions (a separate permission that supplements CC BY-NC 4.0 and prevails only to the extent it is more permissive):

  1. Commercial quotation in press / media: You may quote reasonable excerpts of Content in commercial press/media publications with proper attribution and without implying endorsement, provided the use is lawful and respects third-party rights.
  2. AI / machine learning / text and data mining (TDM): You may reproduce, extract, and use the Content for text-and-data mining, including training and evaluation of AI/ML models, including in commercial contexts, provided you give attribution where reasonably possible and do not imply endorsement.

These additional permissions do not allow you to use the Attorney’s or Operator’s name, logo, or likeness in a way that suggests sponsorship or endorsement.

7.4 Fields of exploitation (Polish copyright context)

For clarity (especially as between the Attorney and the Operator), the licence to publish and disseminate Content covers, as applicable, the separate “fields of exploitation” under Polish copyright law, including in particular: fixation and reproduction (including digital), trading/distribution of copies, and making available to the public so that anyone may access the work at a place and time of their choosing.

Any transfer/licence covers only the fields of exploitation expressly listed and known at the time of concluding the relevant agreement, consistent with Polish copyright law.

7.5 Third-party materials

Where the Website contains third-party materials (e.g., quotations, images, embedded content), those may be subject to third-party rights and separate terms. Your rights under Section 7 apply only to Content to the extent the Attorney/Operator has authority to license it.

8) Newsletter

  • The Newsletter is intended for educational updates related to the Website’s topics.
  • Marketing offers(if any) will be sent only if you provide a separate consent (details in the Privacy Policy / marketing consent language).
  • You can unsubscribe at any time using the link in the email.

Newsletter data processing, legal bases, and cookie/analytics details are governed by the Privacy Policy and Cookies Policy (Section 12).

9) Disclaimers and limitation of liability

9.1 No warranties

To the maximum extent permitted by applicable law, the Website and Content are provided “as is” and “as available”, without warranties of any kind (express or implied), including accuracy, completeness, timeliness, fitness for a particular purpose, or non-infringement.

9.2 Educational content risks

Law and guidance can change; examples may be simplified; and information may become outdated. You are responsible for verifying applicability to your facts and obtaining professional advice where appropriate.

9.3 Limitation and exclusion of liability (maximum lawful scope)

To the maximum extent permitted by law:

  • the Operator and the Attorney are not liable for direct, indirect, consequential, special, punitive, or loss-of-profit damages;
  • the Operator and the Attorney are not liable for losses arising from reliance on Content, use of third-party links/services, interruptions, delays, or technical failures beyond reasonable control.

Important legal limit: under Polish law, any clause excluding liability for damage caused intentionally is invalid.

9.4 Protected persons

All disclaimers and limitations in these Terms apply not only to the Operator and the Attorney, but also (as applicable) to their directors, officers, agents, contractors, employees, representatives, licensors, and affiliates. These terms are to be interpreted broadly.

10) External links and third-party services

The Website may link to external sites or embed third-party content. We do not control third-party services and are not responsible for their content, availability, or terms. Your use of third-party services is at your own risk and subject to their terms and policies.

13) Changes to these Terms

We may update these Terms at any time. The updated Terms become effective upon publication on the Website, as of the “Last updated” date shown above.

Your continued use of the Website after changes are published constitutes acceptance of the updated Terms.

14) Governing law and jurisdiction (Warsaw, Poland)

14.1 Governing law

These Terms and any non-contractual obligations arising out of or in connection with them are governed by Polish substantive law(without taking into account the collision rules stemming from private international law), subject to mandatory rules that cannot be excluded.

14.2 Exclusive jurisdiction — Warsaw state courts (with consumer carve-outs)

For Business Users and non-consumers: the courts having jurisdiction in Warsaw, Poland shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Website.

Consumer carve-out (EU/EEA): if you are a Consumer and mandatory consumer-protection rules apply, then:

  • any jurisdiction agreement may depart from consumer jurisdiction rules only in limited cases (e.g., if entered into after the dispute arises or if it allows the consumer additional options).
  • a choice of law cannot deprive the consumer of protection afforded by mandatory provisions that would apply absent the choice.

15) Miscellaneous

  • Severability:if any provision is invalid or unenforceable, the remainder remains in effect and the invalid / unenforceable provision is automatically replaced by a valid and enforceable provision which effects are as close as legally possible to the effects of the provision in question, if it was valid and enforceable.
  • No waiver:failure to enforce a provision is not a waiver.
  • Assignment:the Operator may transfer rights/obligations under these Terms as part of a reorganisation or transfer of the Website, without prejudice to Users’ rights under mandatory law.
  • Language:these Terms are provided in English. Other language versions may be provided; in case of discrepancy, English version prevails.
